제1조 (목적)Article 1 (Purpose)
이 약관은 근방(이하 ‘회사’)이 제공하는 단기 임대 매물 탐색, 예약·계약 지원, 결제 및 관련 온라인 서비스(이하 ‘서비스’)의 이용조건과 회사와 회원의 권리·의무 및 책임사항을 정함을 목적으로 합니다.These Terms govern the use of short-term rental discovery, booking and contract support, payment, and related online services provided by Geunbang (the “Company”), including the rights, obligations, and responsibilities of the Company and its members.
제2조 (정의)Article 2 (Definitions)
‘회원’은 이 약관에 동의하고 계정을 생성하여 서비스를 이용하는 자를 말합니다. ‘호스트’는 매물 또는 공간을 등록하고 임대를 제안하는 회원을, ‘게스트’ 또는 ‘임차인’은 매물을 탐색하고 예약·계약하는 회원을 말합니다. ‘게시물’은 회원이 서비스에 등록한 문자, 사진, 정보 등을 의미합니다.A “Member” is a person who agrees to these Terms, creates an account, and uses the Service. A “Host” lists a property or space and offers it for rent. A “Guest” or “Tenant” searches for, books, or contracts for a property. “Content” includes text, photos, and other information uploaded by members.
제3조 (약관의 게시와 개정)Article 3 (Posting and Amendments)
회사는 회원이 쉽게 확인할 수 있도록 서비스 화면에 이 약관을 게시합니다. 관련 법령을 위반하지 않는 범위에서 약관을 개정할 수 있으며, 회원에게 불리하거나 중요한 변경은 적용일과 변경 사유를 정해 사전에 공지합니다. 법령상 별도 동의가 필요한 변경은 해당 절차를 따릅니다.The Company posts these Terms where members can easily review them. The Company may amend them to the extent permitted by applicable law. Material or unfavorable changes will be announced in advance with their effective date and reason. Where separate consent is legally required, the applicable consent procedure will be followed.
제4조 (회원가입 및 계정관리)Article 4 (Registration and Account Management)
회원은 정확하고 최신의 정보를 제공해야 하며 타인의 정보를 사용할 수 없습니다. 계정과 비밀번호 관리 책임은 회원에게 있으며, 도용 또는 무단 사용을 알게 된 경우 즉시 회사에 알려야 합니다. 회사는 허위정보 제공, 법령 또는 약관 위반 등 합리적 사유가 있는 경우 가입을 제한하거나 이용을 정지할 수 있습니다.Members must provide accurate, current information and may not use another person's information. Members are responsible for safeguarding their accounts and passwords and must promptly notify the Company of suspected theft or unauthorized use. The Company may restrict registration or suspend use for reasonable grounds such as false information or violations of law or these Terms.
제5조 (서비스의 제공 및 변경)Article 5 (Service and Changes)
회사는 매물 검색·등록, 예약·계약 관리, 결제·정산 지원, 알림·메시지, 분쟁 처리 지원 등 서비스를 제공합니다. 운영 또는 기술상 필요한 경우 서비스의 전부 또는 일부를 변경하거나 중단할 수 있으며, 회원에게 중대한 영향을 주는 경우 가능한 범위에서 사전에 안내합니다.The Service may include listing search and registration, booking and contract management, payment and settlement support, notifications, messaging, and dispute support. The Company may change or discontinue all or part of the Service for operational or technical reasons and will provide advance notice where reasonably possible if the change materially affects members.
제6조 (거래 당사자와 중개 역할)Article 6 (Parties and Platform Role)
회사는 원칙적으로 호스트와 임차인이 거래를 체결할 수 있도록 온라인 환경을 제공하는 중개 플랫폼입니다. 개별 거래에서 회사가 직접 계약 당사자로 명시된 경우를 제외하고, 매물의 소유·적법성·상태와 실제 임대차의 이행 책임은 해당 거래 당사자에게 있습니다. 다만 회사는 관련 법령상 플랫폼 사업자에게 부과되는 의무와 회사의 귀책사유에 따른 책임을 부담합니다.The Company generally operates as an online platform that enables Hosts and Tenants to transact. Unless the Company is expressly identified as a direct contracting party, the relevant parties are responsible for ownership, legality and condition of a property and performance of the lease. The Company remains responsible for obligations imposed on platform operators by law and for matters attributable to the Company.
제7조 (매물 등록 및 정보의 정확성)Article 7 (Listings and Accuracy)
호스트는 매물의 권리관계, 소재지, 이용조건, 가격, 관리비, 제한사항, 사진 등 거래 판단에 중요한 정보를 사실에 맞게 제공해야 합니다. 허위·과장·누락 정보 또는 제3자의 권리를 침해하는 게시물은 등록할 수 없습니다.Hosts must accurately provide material information relevant to a transaction, including rights to the property, location, conditions of use, price, management fees, restrictions, and photos. False, exaggerated, materially omitted, or rights-infringing content may not be posted.
제8조 (예약·계약 및 취소)Article 8 (Bookings, Contracts, and Cancellations)
예약, 계약, 변경, 취소 및 환불 조건은 각 거래 화면에 고지된 조건과 당사자 간 계약 내용에 따릅니다. 전자상거래법 등 관계 법령에서 청약철회 또는 환불에 관한 별도 기준이 적용되는 경우 해당 법령이 우선합니다. 회사는 거래 단계별 주요 조건을 회원이 확인할 수 있도록 제공합니다.Bookings, contracts, changes, cancellations, and refunds are governed by the terms shown for the relevant transaction and the agreement between the parties. Mandatory withdrawal or refund rules under applicable law take precedence. The Company provides key conditions for members to review at each transaction stage.
제9조 (결제 및 정산)Article 9 (Payments and Settlement)
유료 거래가 있는 경우 결제수단, 금액, 수수료, 환불 기준 등은 결제 전 화면에 표시합니다. 회사는 결제대행사 등 외부 사업자를 통해 결제를 처리할 수 있으며, 정산 보류·상계 등이 필요한 경우 그 사유와 기준은 관련 법령 및 별도 정책에 따릅니다.For paid transactions, payment methods, amounts, fees, and refund standards are displayed before payment. Payments may be processed by third-party providers. Any withholding or offset of settlement amounts will follow applicable law and relevant policies.
제10조 (회원의 금지행위)Article 10 (Prohibited Conduct)
회원은 법령 위반, 사기 또는 기망, 허위매물 등록, 타인의 계정·개인정보 도용, 서비스 장애 유발, 비정상적인 접근·자동화 수집, 지식재산권 침해, 플랫폼 외 거래를 강요하여 다른 이용자에게 손해를 주는 행위, 그 밖에 서비스의 안전과 신뢰를 훼손하는 행위를 해서는 안 됩니다.Members must not violate law, engage in fraud or deception, post false listings, misuse another person's account or personal information, disrupt the Service, perform abnormal access or automated collection, infringe intellectual property rights, force off-platform transactions that harm other users, or otherwise undermine the safety or trust of the Service.
제11조 (게시물과 권리)Article 11 (Content and Rights)
회원이 작성한 게시물의 권리는 원칙적으로 해당 회원 또는 정당한 권리자에게 귀속됩니다. 회원은 서비스 운영·노출·검색·홍보에 필요한 범위에서 회사가 게시물을 저장, 복제, 표시, 형식 변환할 수 있도록 허용합니다. 회사는 권리침해 신고 또는 법령 위반 소지가 있는 게시물을 필요한 범위에서 제한할 수 있습니다.Rights in member-created content generally remain with the member or lawful rights holder. Members permit the Company to store, copy, display, and reformat content as reasonably necessary to operate, surface, search, and promote the Service. The Company may restrict content where necessary in response to rights claims or potential legal violations.
제12조 (서비스 이용 제한 및 계약 해지)Article 12 (Restriction and Termination)
회원은 언제든지 제공되는 절차에 따라 탈퇴를 요청할 수 있습니다. 미완료 거래, 정산, 분쟁 또는 법령상 보존의무가 있는 정보는 필요한 기간 동안 별도로 보관될 수 있습니다. 회사는 중대한 약관 위반, 반복적인 거래 방해, 부정 이용 등이 확인된 경우 사전 통지 후 이용을 제한할 수 있으며 긴급한 피해 방지가 필요한 경우 우선 제한 후 통지할 수 있습니다.Members may request account termination through the provided process. Information relating to incomplete transactions, settlements, disputes, or legal retention duties may be retained for the required period. The Company may restrict use after notice for material violations, repeated interference with transactions, or abuse, and may act first and notify afterward where urgent harm prevention is necessary.
제13조 (개인정보 보호)Article 13 (Privacy)
회사는 개인정보 보호법 등 관계 법령을 준수하며, 개인정보의 처리 목적·항목·보유기간·이용자의 권리 등 구체적인 사항은 개인정보처리방침에서 안내합니다.The Company complies with applicable privacy laws. Details including purposes, data categories, retention periods, and user rights are described in the Privacy Policy.
제14조 (책임의 범위)Article 14 (Scope of Liability)
회사는 회사의 고의 또는 과실로 회원에게 손해가 발생한 경우 관계 법령에 따라 책임을 부담합니다. 천재지변, 통신망 장애, 제3자의 불법행위 등 회사가 합리적으로 통제하기 어려운 사유로 발생한 손해에 대해서는 회사의 귀책이 없는 한 책임을 부담하지 않습니다. 이 조항은 소비자보호 관련 강행규정을 제한하지 않습니다.The Company is liable under applicable law for damage caused by its intent or negligence. The Company is not liable, absent fault, for damage caused by events beyond its reasonable control such as natural disasters, network failures, or unlawful acts of third parties. This provision does not limit mandatory consumer-protection rules.
제15조 (분쟁 처리)Article 15 (Dispute Resolution)
회사와 회원은 서비스 이용과 관련한 분쟁을 원만히 해결하기 위해 성실히 협의합니다. 소비자는 관련 법령에 따라 소비자분쟁조정기구 등에 피해구제를 신청할 수 있습니다.The Company and members will work in good faith to resolve disputes related to the Service. Consumers may seek relief through consumer dispute-resolution bodies as permitted by applicable law.
제16조 (준거법 및 관할)Article 16 (Governing Law and Jurisdiction)
이 약관은 대한민국 법령을 준거법으로 합니다. 소송이 필요한 경우 민사소송법 등 관계 법령이 정한 관할법원에 제기합니다.These Terms are governed by the laws of the Republic of Korea. Any litigation will be brought before the court having jurisdiction under the Korean Civil Procedure Act and other applicable laws.
